Pending Education Law: Certified Excavator Program Requirements

So far, 2018 has been a busy year full of accomplishments and progress. As we enter the final months of the year, I would like to share important updates not only for Dig Safely New York, but for our industry as a whole.

For the first time since NYS Code Rule 16 NYCRR Part 753 was implemented into law, the New York State Legislature passed a bill that will add safety training requirements for certain excavators around the state to help ensure the protection and well-being of our underground infrastructure and communities. 

On Monday, June 18, 2018, New York State Legislature passed Senate Bill S.6756 and Assembly Bill 9985. While you can click here to access the complete bill, I want to summarize the education aspects of this legislation. Once this bill is signed into law by Governor Andrew Cuomo, excavators that work for a local government and their hired contractors, as well as excavators that work for an operator and their hired contractors, will be required to receive training and education from their local one-call center. Under this bill, the Dig Safely New York Certified Excavator Program in Safe Digging Best Practices constitutes as adequate training.

Next steps of this include Governor Andrew Cuomo, reviewing and signing the bill into law. There is not a time frame of when this will be provided to Governor Cuomo; however, excavators impacted by the bill will have 180 days to receive the training to comply with the new law, once it has been signed.
